Part 2 - Retaining Talent

This second seminar of the series is focused on topics that pertain throughout the engagement, especially those that concern the way a worker is characterized is various legal contexts. Determining the proper visa status, exemption status, employee/contractor status, and tax status can all turn on the worker's job responsibilities, which can be difficult to pin down and can change over time.

The topics to be covered in this seminar include:

  • Independent contractors versus employees
  • Exemption status and other wage issues
  • Green cards - when to apply and what is the cost?
  • Tracking time spent on visas - watch for traps with green card applications!
  • Change in employment - when are new petitions required?
  • Extension and transferring of visas
  • Family considerations for visa holders

Part 3 - The End of the Engagement

This third seminar of the series is focused on the end of the engagement. The simple fact is that most hires, at some point, end. Sometimes it is by design. Sometimes it is a function of immigration limitations. And sometimes the worker or the company just find it best to part ways. But in all of these circumstances, the company should take steps to ensure that the worker is treated fairly while the company's interests are protected fully.

The topics to be covered in this seminar include:

THE PRESENTERS

Keith represents companies, organizations, universities, non-profits, individuals, and professional sports franchises to procure temporary visas, work authorization, lawful permanent residence, citizenship, and other immigration benefits in the United States. Keith's clients include Fortune 500 companies, multinational corporations, and entities that are new to the United States. He has also worked with numerous individuals, families, domestic violence victims, and asylum clients to successfully petition for visas and green cards. He has represented clients before U.S. Citizenship & Immigration Services, the U.S. Department of State, in Immigration Court and at Consulates and Embassies around the world.

In addition to U.S. immigration law, Keith provides immigration assistance to multinational corporations sending employees to offices outside of the United States. Through a global network of immigration lawyers, he works with many clients to relocate existing or hire new employees in over 100 countries worldwide.

Keith has also developed a unique specialization in representing professional sports leagues, franchises, and athletes in visa and immigration matters. Keith consults with numerous sports leagues on visa and immigration matters. He represents professional sports teams from all over the United States and has worked with Olympians and professional athletes to procure U.S. lawful permanent residency.

Keith additionally consults, counsels, and trains corporate clients on properly completing the I-9 process, with establishing best practices for complying with immigration laws, with layoffs and reductions in force, and with other issues that arise when hiring foreign personnel.

 

Joseph LaferreraJoseph Laferrera is a partner at Gesmer Updegrove LLP, and heads the employment department at the firm. He is also one of the firm's litigation partners, and heads the firm's data privacy and security practice area as well.

Wearing his employment law hat, Joe has extensive experience representing both employers and employees in a variety of contexts, from issues involving hiring to those involving termination, and everything in between. That may take the form of counseling and training to minimize corporate exposure for discrimination or harassment claims; drafting, assessment and enforcement of employment, separation, non-compete, inventions and related agreements; negotiation of executive compensation packages; and dispute resolution.

As one of the litigation partners in the firm, Joe helps clients not only represents clients in court, he helps those clients avoid disputes by counseling them on business strategies that minimize litigation risk and by addressing problems before they become lawsuits. Joe represents clients in all stages of the litigation process, in state and federal trial courts, before governmental agencies, in appellate matters, and in mediations and arbitrations. These matters may involve intellectual property rights, contractual disputes, corporate governance issues, and myriad other areas of the law.

Joe also heads the firm's Data Security and Privacy practice area, guiding his clients through the statutory and regulatory morass that governs business and personal data. He is familiar with the myriad federal laws touching on privacy (such as HIPAA, Sarbanes-Oxley, Graham-Leach-Bliley, and "Red Flag" requirements), states' differing approach to data breach notification, and Massachusetts' extensive regulatory scheme mandating comprehensive written information security plans. Joe provides clients with insight and practical advice on protecting the security and privacy of their data.

Joe also works with clients on all manner of intellectual property issues, representing clients in copyright, trade secret and trademark matters.
