Yesterday the Department of Commerce pre-released the text of a new Interim Final Rule laying out the detailed guidance standards setting organizations (SSOs) have been requesting for more than a year to inform them whether they can allow Huawei to participate in their working groups. That’s the good news. The bad news is the new requirements go well beyond what the Department’s policy goals actually require, meaning that most SSOs will need to make substantial changes to their rules and processes in order to comply.
